Family court hears fine matters of exceptional delicacy. Jurisdiction includes cases of crisis that are emotionally laden. The judges of the family court are in charge of ruling intricate verdicts that will have a serious impact on parties involved. The well-being of children is mostly in the jurisdiction of the family court. Parties experience an intense sorrow because of these verdicts. The family court must promptly resolve the legal conflicts that the families are experiencing, mainly in a manner that is in the best interest of the children.
The establishment of the? It was an obligation to establish a system in which family matters and familial relationship conflicts would be examined in specialized courts. The incongruity between the codes of civil law and criminal law in matters involving the woman, the man and the child; i.e. the family are complex and need to be handled by an expert.
Article 4787 which was established in 18/1/2003, aims at protecting the family members and states:? The Ministry of Justice is to employ a psychologist, a pedagogue and a social worker who are preferably married with children and above the age of 30, and with a graduate degree in familial conflicts, to fulfill the below mentioned responsibilities: 1. to explore, examine and report the reasons of dispute between the parties, before or during the trial, as required by the court; 2. to show up for the trial if requested by the court; and examine and report an expert witness opinion if asked for; and 3. accomplish any requests of the court.? As a result of these improvements in the legal system, all family disputes will be held in the Family Court, and the judge will consult the experts, namely psychologists, pedagogues, and social workers in resolving these disputes. The agenda of the meeting to be held includes the expectations from the experts who will be working in this area, the needs of the experts, and the problems and necessities that this system brings along.
